Noise restricted in Liberty Township

To promote peace and tranquility, Liberty Township Trustees have adopted noise regulations [Resolution 11-C-06] that prohibits excessive noise in residential areas and certain premises where liquor is sold.  Among other things the noise resolution applies to:

  • Private construction activities after 9 p.m. and before 6:30 a.m. DST (7 a.m. EST), and before 10 a.m. on Sundays.

  • Horns, music, amplified sound, power equipment other than mowers, trimmers, chain saws, or tillers, and unreasonably long periods of repeated discharging of firearms.

  • Excessive noise from motor vehicles.

Prohibited noises are those audible at a distance of 100 feet or more from the property from which the noise emanates.

The resolution provides for several exceptions, including construction, repairs and maintenance of homes and outbuildings, accessory buildings, or yards.

The Fairfield County Sheriff is responsible for enforcement.

The resolution provides that the township trustees shall seek injunctive relief against people who violate the resolution and provides that a person aggrieved by another person’s violation of the regulation may seek civil action.

The resolution was adopted pursuant to Ohio Rev. Code § 505.172. Violations are a misdemeanor of the second degree.
